India's Trade Marks Registry proposes mandatory AI disclosure in filings
India's CGPDTM has published draft guidelines requiring every applicant, agent and advocate to declare whether AI was used in a Trade Marks Registry submission. The draft bars AI-generated affidavits and AI-altered evidence, mandates independent verification of AI citations, and takes effect once notified.
- Each filing must declare AI use; non-disclosure counts as misrepresentation
- AI-suggested citations and facts must be cross-checked against primary sources
- AI cannot generate affidavits or alter evidence like labels, invoices and translations
- Violations may lead to striking off the submission and disciplinary referral
