Vodacom keeps Safaricom control pending appeal
Kenya's Court of Appeal agreed to fast-track Vodacom's challenge to a ruling that voided its purchase of 15% of Safaricom from the government for KSh204.3 billion. The shares remain registered to Vodafone Kenya and the purchase price is preserved until the appeal is heard.
- Vodacom bought 15% of Safaricom from Kenya and 5% from Vodafone, raising its stake from 35% to 55%
- The high court ruled on 15 September that the sale was unconstitutional and ordered the shares returned to the state
- The Court of Appeal fast-tracked the appeal and maintained the status quo on the shares
- If the ruling stands, Vodacom's stake would fall to about 40% and it would lose majority control
