31 US states have election deepfake laws, but most only require AI labels
The National Conference of State Legislatures counts 31 states with election deepfake laws, 28 of which require only an AI disclosure. Louisiana lets labeled fake ads stay on air, while Maryland bans certain deceptive deepfakes even with a warning. By September 2026 the Wesleyan Media Project found at least 164 AI-made political ads worth nearly $80 million, about 70% without disclosure.
