Brazil bans AI from making administrative decisions
Under Brazil's Lei 14.133/2021 and TCU Acórdão 2.896/2023, administrative acts must be performed, justified and signed by a human public agent. AI may only assist, not replace the legal decision-maker; all decisions require human review and signature.
- Lei 14.133/2021 requires personal justification and signature of a public servant for each act
- TCU Acórdão 2.896/2023 prohibits automated final decisions in administrative processes
- Orientação Normativa 01/2024 mandates human validation and audit logs for AI
- IBM Granite models in Brazilian public sector enforce mandatory human approval
