EU regulator: smart glasses makers can't shift privacy duties to users
The European Data Protection Board (EDPB) adopted guidance on October 13 stating that smart glasses makers and their AI app providers must meet GDPR obligations themselves rather than relying on users' actions. Recording signals such as LEDs, audio cues and Bluetooth alerts must be on by default and hard to disable. In India, where Ray-Ban Meta glasses have sold since May 2025, no regulatory guidance exists and bystanders have filed legal notices and police complaints.
- EDPB requires default recording signals: LED, shutter sound, Bluetooth alerts
- Glasses must stop recording if someone covers the LED
- Using bystander footage to train AI is 'particularly difficult' to justify
- Norway proposed a temporary ban on AI glasses in parks, schools and gyms
